The review examines a claim made in a video circulated on several websites by Heinrich XIII Prince Reuß, whom it identifies as the alleged leader of a group arrested in early December 2022 over a suspected coup plot. Reuß argued that the UN Charter treated Germany as an “enemy state,” proving it was not sovereign. The review says this conclusion is false. It explains that the term appears in three Charter articles—53, 77 and 107—and that Germany is not named explicitly. Article 53 nevertheless defines an “enemy state” as one that was an enemy of a Charter signatory during the Second World War, which the review says implicitly encompasses Germany in that historical context. The review’s decisive qualification is that the UN General Assembly declared the enemy-state clauses obsolete in a 1994 resolution. It also cites the Bundestag’s Research Services for the point that the clauses had no practical relevance since West and East Germany joined the UN in 1973. The continued presence of the wording in the Charter therefore does not establish that Germany is currently subject to the status or lacks sovereignty. For the sovereignty question, the review points to the 1990 Two Plus Four Treaty, which it says settled the foreign-policy arrangements of the reunified Germany with the Allies. It quotes Article 7 as ending the four powers’ “rights and responsibilities” concerning Berlin and Germany as a whole, and describes this as ending Germany’s special status under the four victorious powers. It also notes that the Basic Law was retained as Germany’s constitution after reunification, citing the Federal Constitutional Court’s statement that “constitution” is another word for the Basic Law. Together, the review’s evidence distinguishes a historical Charter term from Germany’s post-reunification legal and political status.

Publisher’s rating: Dit is fout.
The claim was that Viktor Orbán announced a Hungarian departure from the EU in a New Year’s address, supposedly because of the EU’s position on LGBTQ+ issues. The review says the alleged speech did not exist: “In de zogenaamde speech zou Orban de houding van de EU tegenover LGBTQ+-zaken bekritiseren en aanhalen als reden voor een Hongaarse exit. Alleen bestaat die toespraak niet.” The review distinguishes the alleged address from a real short video. It describes that video as a montage of the preceding year in which Orbán comments, but says it contains no announcement of an EU exit: “Een korte video met een fotomontage van het afgelopen jaar werd gepubliceerd waarin Orban ook commentaar geeft. Daarin wordt echter geen melding gemaakt van een mogelijke exit uit de EU.” To check whether an address had been published, the review reports searching the Hungarian government’s official website and Orbán’s personal website; it found no trace of one on either. It also says Hungarian media carried no report of the supposed announcement, which the review notes would have been a historic decision: “Op de officiële website van de Hongaarse overheid is evenmin enig spoor te vinden van een nieuwjaarstoespraak. Hetzelfde geldt voor de persoonlijke website van Viktor Orban.” The review’s evidence therefore points to a fabricated announcement, not a real address or an announcement omitted from the montage.

Video of Rahul Gandhi mentioning India’s population in terms of rupees
Publisher’s rating: MISLEADING
The video concerns Rahul Gandhi speaking at a public rally in Panipat, Haryana. In the clip circulating online, he says India has “a population of 140 crore rupees.” FACTLY reports that this was a verbal slip, not his complete statement: he immediately corrected himself, saying the population was 140 crore people. The review’s conclusion is that the circulating clip leaves out that correction. FACTLY describes checking the clip against a longer version posted by Congress member Rahul Kajal in response to a tweet by BJP’s Amit Malviya. It also says it found the Indian National Congress YouTube channel’s full video of Gandhi’s Panipat speech. In that footage, beginning at 1:45, Gandhi makes the rupees mistake and then says “140 crore people.” The omitted correction changes how the excerpt reads: the short version presents the mistake without the immediate clarification. The review also reports that Gandhi then discussed the concentration of wealth, saying that the money held by half the population was held by the country’s top 100 richest people. That wider passage provides context for his point, but the decisive evidence about the clip is the longer footage showing his correction.
