The claim described a group from Mulhouse causing damage at an Aldi supermarket in Müllheim, Germany, after which police supposedly arrested them and seized their vehicle. The review says a Facebook user presented the story as having been reported by the French regional newspaper L’Alsace, while suggesting Belgian media had remained silent. The account, however, was not evidence that the incident had happened: the review identifies it as a French story that had circulated years earlier and was translated into Dutch. [S1]

Pagella Politica examines Nicola Morra’s claim that a person in Italy can be deprived of liberty “only and only” after a prosecutor’s request is approved by a judge. Morra was commenting on the acquittal of Lodi mayor Simone Uggetti and Luigi Di Maio’s apology for the public shaming Uggetti had faced in 2016. The review says Morra’s description is broadly accurate for the ordinary process of imposing pretrial measures, but that its absolute wording leaves out other ways liberty can be restricted. For a precautionary measure, the prosecutor makes the request and the judge cannot initiate one independently or impose a more severe measure than the prosecutor sought. The judge considers whether the request is justified; the review notes that the judge need not always be a preliminary investigations judge (gip), because precautionary needs may arise later in the proceedings. The article explains that the ordinary process also requires a risk such as flight, interference with evidence, or reoffending, alongside a judicial assessment that the suspect’s guilt is sufficiently probable. The decisive qualification is that arrest and detention (fermo) can initially occur without a prior joint decision by prosecutor and judge. The review describes these as “precautionary” measures: an arrest commonly follows a person being caught in the act, while a detention may be ordered because of flight risk. In the arrest example, the person must be made available to the prosecutor within 24 hours; the prosecutor then has 48 hours to ask a judge to set a validation hearing, which must take place within the following 48 hours. Thus, a person may be deprived of liberty before a judge is involved, although the process is time-limited and subsequent judicial validation is required. The review’s conclusion is that Morra’s account describes the usual procedure for precautionary measures but omits this important exception.

Image showing police clamping lockdown violators legs to a wooden plank in Thailand
Publisher’s rating: MISLEADING
The claim concerns an image said to show Thai police clamping lockdown violators’ legs to a wooden plank. FACTLY reports that the image instead shows a 2020 incident in Colombia: police in Tuchín, Córdoba, punished residents for violating restrictions by clamping them to wooden planks. The review says the image “has nothing to do with Thailand.” To check the image’s provenance, the review describes a reverse image search that led to the same photo on Wikimedia Commons. It also says the image’s Wikimedia metadata places it in Colombia and dates it to 11 April 2020. A further search using relevant keywords found Brazilian news articles that the review says also identify the incident as taking place in Colombia. On the evidence described, the image’s location and date contradict the claim that it depicts a Thai lockdown enforcement incident.
